很多H1B没有抽中，选择Day-1 CPT学校就读继续Fulltime工作的同学们可能都有这样的顾虑——Day-1 CPT会不会让后面的H1B和绿卡申请被RFE Request for Evidence ？事实上，拜登当选美国总统以来，大趋势上因为Day-1 CPT被RFE的案例越来越少了，尤其是那些选择了成立时间长，认证完善，在地区广受认可学校进行CPT的同学们（并且专业选择合理）被RFE的几率其实很低。
附上几个最近CPT期间H1B被抽中并直接Approve的例子
那因为CPT被RFE主要会有哪些原因呢？通常USCIS可能用以下理由要求RFE：
新修的Master学位和之前获得的Master学位专业太过类似
F1学生身份没有被合法维持， CPT被滥用
课程内容与CPT的工作内容相关度低
同一学位下CPT和OPT使用时间过长，CPT被滥用
即使因为CPT被RFE了，同学们也不用太担心，请及时联系移民律师，商讨应对的策略。很多律师对处理H1B申请中因为CPT被RFE的情况都很有经验，他们会协助同学们从申请CPT的出发点、申请过程以及使用CPT的具体过程来陈述CPT的意图和合理性（To demonstrate the beneficiary's CPT was directly related to his or her major of study）；同时，他们也会结合同学们在校就读的课程、研究项目、依旧正常就读的证明，证明其学习目的，论证其在校期间进行全职CPT的合法性（To demonstrate the beneficiary was maintaining a full course of study）。
CPT被RFE的补件策略（来自一亩三分地用户creazy-lobster）：

通常而言，只要你在RFE补件材料中，有效阐述到了以上两点，USCIS都会认可。偶尔情况下，USCIS 也有可能拒绝境内身份转换申请 （Change of status）的同时批准 H1b 的申请，要求学生出境签H1b再入境（Consular Processing）。
除了律师帮助我们准备补件，还有一个很关键的因素会影响我们补件是否成功，那就是Day-1 CPT学校给予学生的支持了。成熟的Day-1 CPT学校都会给学生准备一个“RFE大礼包”，尽最大程度的协助学生证明其在校期间的正常学习以及CPT没有被滥用（To demonstrate the beneficiary was maintaining a full course of study）。
以D同学的经历为例：D同学在Westcliff就读并使用CPT工作，期间抽中了H1B，在材料审核时不幸被RFE，要求证明合法Maintenance of Status。D同学和律师积极准备补件材料，自己准备了项目期间的停车票、机票、酒店、课本、其他学习材料等凭证，证明自己有遵守学校的出勤规则；另外也联系了学校，学校积极配合了D同学，为其提供了出勤记录、CPT协议副本、注册证明、官方成绩单、学业记录、学生卡、学费记录以及一封学校官方RFE Support说明信。信里说明了这个学生注册 CPT 课程的原因，是因为学校规定 CPT 的课程实习是完成这个项目不可或缺的组成部分（重点强调 CPT 是学校的要求，而不是学生的选择）。最终D同学凭借这些材料顺利的通过了RFE，并直接在美国境内转换了身份（COS）。
例如下方截图是 Westcliff University 官方Catalog学生手册截图，明确说明 graduate degree的学生必须完成最少一段实习才能毕业。
大部分靠谱的的Day-1 CPT学校都会准备这么一个RFE“大礼包”提供给学生，里面的内容包括：
RFE Support Letter 学校官方证明信
Attendance Report出勤记录
CPT Corporate Agreement CPT协议副本
Enrollment Verification 注册证明
Official Transcript 官方成绩单
Academic Record 学业记录
Tuition Record 学费记录
有的学校需要学生通过邮件联系Advisor和DSO获得这个RFE“大礼包”；有的学校则可以直接在Student Portal申请RFE Support，“自助”获得证明材料。
"Based on the RFE and what is requested for the student to provide to USCIS, the University can provide any documents in relation to the student's academic program as well as information related to their F-1 status (ie. CPT authorization, etc.) based on the requested list.”
通常每年的5月和10月是学校处理RFE的高峰期，同学们记得收到RFE Notice就马上联系学校呀！
